1. Acceptance of Terms

By accessing or using Top Exquisite Market ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.

These terms apply to all users of the Platform including buyers, sellers, and visitors.

2. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when registering. Providing false information may result in account suspension.

3. Seller Requirements

All sellers on Top Exquisite Market must:

• Verify their National Identification Number (NIN) before posting products
• Provide accurate product descriptions, photos, and pricing
• Ship items within the agreed timeframe after payment is confirmed
• Mark orders as "Shipped" in their dashboard once dispatched
• Respond to buyer messages within 24 hours

Sellers who violate these requirements may have their accounts suspended or permanently banned.

4. Buyer Responsibilities

Buyers agree to:

• Confirm receipt honestly — only after actually receiving the item in good condition
• Raise disputes within the allowed timeframe if there is a problem
• Not attempt to fraudulently raise disputes after receiving satisfactory items
• Communicate through the Platform's messaging system

5. Payments & Escrow

All payments on the Platform are processed through Paystack. When a buyer makes a payment, the funds are held in escrow and are not released to the seller until the buyer confirms receipt.

If the buyer does not confirm receipt within 7 days of the item being marked as shipped, funds are automatically released to the seller.

Refunds are only issued when the admin rules in favour of the buyer following a dispute resolution.

6. Disputes

If a buyer has a problem with their order, they may raise a dispute before the auto-release timer expires. Both parties will be given the opportunity to present their case.

The Platform's admin team will review the dispute and make a final decision. This decision is binding on both parties. The admin may decide to refund the buyer fully, partially, or release payment to the seller.

7. Prohibited Items

The following items are strictly prohibited on the Platform:

• Illegal drugs, weapons, or explosives
• Counterfeit or stolen goods
• Adult content
• Live animals
• Items that infringe on intellectual property rights
• Alcohol and tobacco without proper licensing
• Any items prohibited by Nigerian law

Violation of this policy will result in immediate account termination and may be reported to relevant authorities.

8. Commission & Fees

The Platform charges a commission on each completed transaction. The commission rate is set by the Platform administrator and may change from time to time. The current rate is displayed in the platform settings.

Free sellers are limited to a set number of product posts per day. A paid subscription plan is available for unlimited posts.

9. Termination

We reserve the right to suspend or terminate any account at our discretion, with or without notice, for violations of these Terms or for any conduct we deem harmful to the Platform or its users.

10. Limitation of Liability

Top Exquisite Market acts as a marketplace facilitator. We are not responsible for the quality, safety, or legality of items listed. While we take all reasonable steps to verify sellers and protect buyers, the Platform is not liable for losses arising from transactions between buyers and sellers beyond what is recoverable through our dispute resolution process.
